In New York, a misdemeanor is defined as an offense, other than a "traffic infraction," for which a sentence to a term of imprisonment in excess of fifteen days may be imposed, but for which a sentence to a term of imprisonment in excess of 364 days cannot be imposed.

Misdmears are crimes and so a misdmeanor conviction in New York will give you a criminal record.

Common misdemeanors include

- Assault in the third degree (such as a typical slap, punch, kick, or domestic violence)

- Drug possession (small amount of drugs)

- DWI

- Petit larceny (theft of $999 or less)
