Our client was arrested for allegedly masturbating inside a bathroom in Penn Station in front of an under-cover police officer. Our client was worried because if the arrest and conviction were discovered by other people, there could be extensive consequences both professionally and personally. After the case evaluation, we asserted our client’s innocence and fought the charges on the grounds of improper police procedure and insufficient evidence to convict. Initially, the prosecutor was demanding a criminal record and sex offender program but following negotiations, we worked it out to a deal where our client would only plead guilty to a non-criminal violation called disorderly conduct and community service.
