Penn Station Exposure / lewdness charges dismissed for college student

Our client was
arrested and given a desk appearance ticket for allegedly masturbating with another
person inside a Penn Station bathroom. This other person turned out to
be an undercover police officer. Our client
contacted us for help because he was studying for a career that frequently involved
background checks and he knew that conviction for lewdness would be difficult
to ever overcome. We took a look at the complaint and the police paperwork
and noticed mistakes that the police made. In court, we maintained our
client’s innocence and pushed for dismissal. After several months
of negotiation and during which the prosecutor was pushing for a criminal
record and punishment under a class A misdemeanor, we successfully negotiated
a deal where our client would only plead guilty to disorderly conduct
and complete
community service but no criminal record, no
jail, and no sex offender program.
