Manhattan possession of stolen property charges dismissed

Our client was
arrested for being in possession of a stolen Amtrak card that was charged as a
misdemeanor but could have been charged as a felony. After being released
from the police station with a desk appearance ticket, our client
contacted us for help. Our client had a prior conviction for theft and was very worried
because conviction in this case could have resulted in a year in
jail. After the consultation, we prepared a defense on the ground that the
prosecutor would not have sufficient evidence of intent. After fighting
in court for a few court dates, we reached a deal that we were able to
take in our client’s absence and that avoided trial because our
client was attending school in another state. The deal called for the
case to be dismissed as long as our client completed some
community service.
