Forcible touching in a nightclub case dismissed for financial professional

Our client was
arrested for allegedly forcibly touching the sexual or intimate parts of another
person inside a crowded Manhattan nightclub. Our client had never been
arrested before and was not a US citizen and so conviction could not only cause
extreme professional and personal injury but could have led to being removed
from the US. After meeting with our client for the
case evaluation, we were convinced that we had to fight on the grounds that there was
insufficient evidence for proof beyond a reasonable doubt. We investigated the
complainant and sought all available police records and any video surveillance. After
a few months of negotiation, we noticed that the prosecutor was making
a procedural error and we successfully moved for a complete and unconditional
dismissal. Our client’s case resulted in no
jail, no criminal record, no sex offender program or registration.
