Domestic violence menacing with a gun dismissed in Brooklyn
2013
Our client was
arrested for allegedly threating his ex girlfriend with a gun. Our client worked
for an employer who often ran background checks and our client was very
nervous about
jail but also a conviction which could ruin his career. Our client
contacted us to review thedomestic violence
menacing charges. We conducted a careful review of the factual allegations by demanding
and collecting all police reports, witness statements, 911 calls, and
other discovery. The prosecutor disclosed much of this material but we
noticed that certain things were missing in the disclosures. In court,
we fought the prosecutor on the grounds that they could not bring it to
trial without a full and fair disclosure of the evidence. After several
months of litigation and fighting for dismissal, we won when the case
was dismissed on procedural grounds
